General Terms of Service

[1] By commissioning marantawings (referred to as "the artist" here), you agree to these Terms of Service.[2] None of the artist's works may be used for non-fungible tokens ("NFTs") or crypto currencies in any way, shape or form. No exceptions.[3] None of the artist's works may be used for training Artificial Intelligence ("AI") bots or generating AI works in any way, shape or form. No exceptions.[4] Additional characters cost the same amount as the initial one (unless one is partially hidden behind another character or similar situations; please inquire about this specifically), minus the background flat rate if a background was requested.
(Example: initial character: 100€; + background +30%; + additional character: 100€ = 230€)[5] The client will select "No address needed" if paying through PayPal. This is needed to ensure PayPal will not ask the artist for a shipping label, and so the artist won't get in trouble for not doing so - this only applies to digital artwork and services, of course.[6] The artist reserves the right to cancel and refund a commission at any time, without explanation.[7] The artist reserves the right to refuse any commission request at any time, without explanation.[8] The client must pay for the commissioned art after the artist has sent them a sketch and the client approved it.[9] If the client cancels a commission before any payment is made, or is refunded, the artist reserves the right to re-use the sketch made for them (not the character, of course - just the pose/composition).
See 25) for more information on refunds.[10] If a client fails to pay for a custom character design or cancels the commission, the artist reserves the right to finish and sell said design if already worked on.[11] Unless a client has paid the full price for a custom character design, the artists holds all rights to the design until it's fully paid off.[12] The artist will send a sketch to the client which has to be approved. The artist will re-do this sketch until the client approves of it. After it has been approved, any progress is shared through the artist's Trello queue unless otherwise discussed.[13] If the client commissions only a sketch and wants to approve it before it is being finished, they must state so before the artist starts and finishes the commission.[14] The artist allows two edits to the commissioned piece during its work in progress ("WIP") stage. Any further edits will cost a fee that will be discussed with the client.[15] The client must provide the artist with a clear visual reference of which they hold the rights to (excluding screenshots from games such as Destiny 2). If a client is found to have stolen said reference/character, the commission will be refunded without notice and can be repurposed.[16] All deadlines must be agreed upon first. Shorter deadlines may require a rush fee. If a shorter deadline is not met by the artist, this rush fee will be refunded.[17] The client should only post a version of the artwork which has a clearly visible watermark on it. The artist does not recommend posting the original size, watermark-free artwork due to art theft.
Due to AI generative software, the artist also recommends using cloaking software like Glaze to prevent commissioned artwork from being used by AI bots.[18] Artwork is strictly for personal use only. Making any profit from the artwork is prohibited (e.g. prints, printing on products for sale etc.). The client must ask the artist for permission first. Using the artwork for AI generative software is prohibited.[19] The artist reserves the right to sell prints and other products of the finished artwork - if you are uncomfortable with this, please let the artist know and they will not use your artwork in this way.[20] The client must pay within a month (30 days) of accepting the final sketch. If the client fails to pay by this deadline, the commission is considered cancelled.[21] The final artwork can be sent through E-mail, Google Drive, or Dropbox. The client must save their artwork after viewing. The artist is not responsible for keeping the artwork on their device. If the final artwork is deleted or is lost, the artist is not responsible for providing the artwork at any time after the client has seen their final artwork.[22] Payments must be made through PayPal unless otherwise discussed.[23] It is not possible to refund any commission after it is finished.[24] A commission is considered finished after the client has approved the finished product (e.g. "Thank you, I like it" or similar responses). The artist is not responsible for any changes to the artwork unless agreed upon.[25] The artist may take any amount of money off of the initial price for refunds if the artwork has already been worked on (e.g. if the coloring process of a flat colored commission is nearly done, the artist may choose a certain amount (e.g. 25%, 50%, 75%) to take off the initial price)). This only applies to commissions the artist cannot re-sell (e.g. a flat colored artwork of a very unique character)[26] The client must ask permission to edit their artwork (e.g. coloring a sketch).

Custom Character Design Terms of Service

1) None of my artworks may be used to train generative Artificial Intelligence (generative AI) or be turned into non-fungible tokens (NFTs).2) Do not trace over my artworks without permission. Permission automatically includes the purchase of pay-to-use linearts, of course; apart from those, and if you haven't purchased the lineart/s, please refrain from doing so as I view it as art theft, which is highly disrespectful.3) Once you purchase a design from me,3a) you're permitted to make spin-off designs of it (designing related characters, like making siblings, offspring etc.);3b) you're permitted to make any edits you wish,3c) you're permitted to resell it at any time, for any price;3d) I strongly advise you to only post artwork of the design with a watermark on it (whether that's your own or my artist watermark);3e) do not pass it off as your own work, as that is highly disrespectful. I don't ask for credits absolutely everywhere, but at the very least, if asked, please do give credit;3f) you're not permitted to use my artwork for profit (e. g. selling shirts, prints, merch of any kind). Should you be caught doing so, I will take legal action;3g) I will not offer refunds for designs already purchased.4) Regarding holds or payment plans:4a) I accept holds for up to a week for designs valued 100 EUR or less; longer for higher priced designs. You can always inquire about those;4b) Payment plans are possible; two payments for designs valued 100 EUR or less; more payments for higher priced designs. Payment plans cannot exceed two months.4c) Should you ask for a hold and not respond after the given time or drop out without any explanation, I reserve the right to blacklist/block you. Please give me a heads up at the very least!5) Should you ask to claim a design, win a bid, or be required to pay through any other means, and you ignore my messages or drop out without any explanation, I reserve the right to blacklist/block you. Please give me a heads up at the very least!6) If my designs are posted to Toyhou.se, I really appreciate the design credit function being used. If my designs are posted outside of Toyhou.se, I would appreciate design/artist credit on the first post of the design; and on every post of an artwork that uses my linearts.7) Should you commission me for a custom design and drop out/cancel after I've already put in a significant amount of work, I reserve the right to finish the design and sell it. I will make rare exceptions if needed (e. g. deep emotional ties to the concept)!8) Until a design is fully paid off, I retain the rights to said design.9) Should anyone break these terms, I reserve the right to refuse service or blacklist/block them.
